Revised Article 9
With the passage of House Bill 1105, Revised Article 9 (RA9) became effective in North Dakota on July 1, 2001. As a result, significant changes occurred under RA9 of the Uniform Commercial Code. Chapter 5 of RA9 deals specifically with filing and the filing officer's responsibilities.
Revised Article 9 did not change where to file in North Dakota. North Dakota has a centralized filing system with 54 filing offices, one in each County Recorder's office and one in the Secretary of State's office. If the proper place to file is North Dakota and that is where you are currently filing, nothing changes. If you are filing a "new filing" or "an in lieu of filing" in North Dakota, you may file in any one of the 54 filing offices (52kb pdf).
