The Adoption and Safe Families Act of 1997 (P.L. 105-89) (ASFA) defined legal guardianship and identified it as a valid permanency option for children. Refer to ADDENDUM for the federal definition of guardianship and “Compilation of Titles IV-B and IV-E of the Social Security Act (11/19/97),” pages 35-39.

 

North Dakota’s response to ASFA is a guardianship provision passed by the 1999 Legislature. This legislation provides the basis for guardianship implementation as a permanency option in several sections of the North Dakota Century Code.  (ADDENDUM)
