I have just moved to North Dakota how do I get a North Dakota title and license plates in my name?

 

SFN 2872 Application for Certificate of Title & Registration of a Motor Vehicle must be completed in full and signed by the owner.

Proof of Legal Name such as Out-of-State License, ND License, Passport, or government-issued photo ID.

Out-of-state title must be submitted with the completed application. If the vehicle is financed, we must have a completed application form, with the name and mailing address of the lienholder, and a copy of the out-of-state registration.

  • If Current Registration cannot be provided, please contact your local ND DMV for additional information.

If your vehicle is titled with Alaska, Delaware, Georgia, Montana, New Hampshire, Oregon, or any Canadian Province, foreign country, or tribal nation - excise tax will be due on the current market value of the vehicle. Any motor vehicle excise, use, or sales tax paid at the time of purchase will be credited.

License fees are based on the year and weight of the vehicle.

Title transfer fee is $5.

Abandoned Vehicle Disposal Fee is $1.50.

How do you remove a name from a North Dakota title when it is in two names or if one owner is deceased?

 

“OR vs AND” conjunctions (see above table in “How to sign off as seller on a title.”)

Part 1 (Seller’s Assignment & Warranty of Title) must be signed and dated by one of the owners(s) as shown on the front of the title. Legal name and address how new title is to read as applicants/buyers.

Odometer information required on all motor vehicles less than ten (10) years old, with the applicant/buyer’s signature, printed name, and date.

Part 3 (Purchaser’s Certification and Application) must be completed and signed by the new owner with tax exemption and lienholder information, if applicable.

Title transfer fee is $5.

  • NOTE: Signing for the deceased requires the appointment of a Personal Representative.
  • NOTE: Affidavit for Collection of Personal Property of the Decedent SFN (SFN 2916) for estates that do not exceed $50,000.

What do I need when selling a vehicle (changing vehicle ownership)?

 

Selling a vehicle with North Dakota title:

Part 1 (Seller’s Assignment & Warranty of Title) (ASSIGNMENT AND WARRANTY OF TITLE) must be signed and dated by seller(s)/transferor(s), completed to include, the buyer/transferee’s name, the purchase price and the purchase date.

A current odometer reading is required on all motor vehicles less than ten (10) years old.

A vehicle less than nine (9) years old SFN 18609 Damage Disclosure Statement must be completed by the seller.

When the owner of a vehicle sells, trades, or otherwise transfers the ownership of the vehicle, the license plate(s) must be removed by the seller and the vehicle will be considered unlicensed.

The owner/seller/transferor shall deliver the endorsed certificate of title to the transferee within fifteen (15) days.

The buyer may operate the vehicle for a maximum of five (5) days from date of acquisition without displaying any visible evidence of registration. However, the applicant/buyer/transferee must have dated evidence of ownership in the vehicle during these five (5) days. Dated evidence of ownership is either a dated bill of sale or a dated copy of the certificate of title.

How to sign off as seller on a title.

When I sell my vehicle am I required to keep my license plate(s)?

Yes. Vehicle owners must remove the license plate(s) from their vehicle whenever the vehicle is sold or transferred. The vehicle will be considered unlicensed, and subject to a full year license fee when re-titled.

How do I apply the credit I have left on my license plate(s)?

The owner of a vehicle, who has removed their license plate(s) from a vehicle at the time it was sold, is allowed a credit towards the registration fee due on the replacement vehicle.

How much credit do I receive when I transfer my license plate(s) to a replacement vehicle?

The credit is based on the number of unused months left on the registration (license plate) when the replacement vehicle is acquired.

The available credit will expire if not used by the expiration date on the plate(s).

Credit is determined starting from the month after the plate(s) are transferred.

The credit will not be available unless the license plate(s) is transferred to the replacement vehicle.

An additional $5 fee is due on each registration and title application that involves a credit.

Transferred plate(s) cannot be displayed on the replacement vehicle until the vehicle has been registered with the Motor Vehicle Division, and a new registration card has been received.

If my credit exceeds my registration fee what happens to the remaining credit?

Available credit can be used towards only one replacement vehicle. If the available credit exceeds the registration fee due on the replacement vehicle, the credit balance will be lost.

The credit balance cannot be used to offset any other fees that are due (ex: title fee and taxes).

There are no refunds available in this situation.

Can I legally operate an acquired vehicle without displaying any visible registration?

Yes. The buyer of a vehicle may operate the vehicle for a maximum of five (5) days from the date of acquisition without displaying any registration.

You must have dated evidence of ownership in the vehicle during those five (5) days.

Dated evidence of ownership can be:

  • A dated bill of sale,
  • Dated copy of the certificate of title or
  • Back of that vehicle’s current registration card.

What if I cannot make it to the DMV within five (5) days to transfer the title on a newly acquired vehicle? How can I legally operate that vehicle?

A self-issuing temporary registration permit can be used for 30 days from the date of acquisition. During this time, the buyer must obtain proper registration and title for the vehicle.

The permit is available on the reverse side of the seller’s registration card, can be acquired on-line or any Motor Vehicle office location.

Can I receive license fee credit from one vehicle to another, regardless of what that vehicle is?

The class of vehicle (license type) does not need to be the same. (Example: motorcycle license credit on a passenger vehicle replacement). As long as the vehicles involved are allowed under Plate with Owner.

To receive the credit, the law requires that vehicle to be sold, traded, or otherwise transferred prior to acquiring the replacement vehicle.

How do I receive license fee credit if I have lost the plate(s)?

If the plates(s)are lost, you may apply for duplicate plates. A $5 duplicate plate fee is due.

Can an immediate family member use my plate(s) and credit?

Yes. If you sold, traded, or otherwise transferred a vehicle and will not be replacing the vehicle; it is allowable for an immediate family member to use the plate(s) and credit on their purchase.

Can my license get suspended for child support?

Yes, your license can get suspended due to child support. The North Dakota Child Support Program can be reached by phone at 701-328-5440 or by email at childsupport@nd.gov 

Why am I suspended if I don’t have a North Dakota permit or license?

All drivers convicted of traffic offenses or involved in crashes in North Dakota are subject to North Dakota law and consequence. Suspension and revocation are enforced on the driving privilege. A physical permit or license is not required to get suspended or revoked in North Dakota. 

If I no longer live in North Dakota, do I still have to meet my reinstatement requirements?

Yes. You are subject to North Dakota law and consequence if a traffic violation occurred in North Dakota OR if the violation occurred while you held a North Dakota ID, permit, or driver license, regardless of where you live. 

How do I request an administrative hearing?

You can request an administrative hearing online here www.forms.nd.gov/240015927075857. You may also request an administrative hearing by mail. An administrative hearing must be requested within 10 days of the issue date on a suspension order. If you are requesting an administrative hearing for an alcohol violation, the hearing must be requested within 10 days of the Report and Notice Temporary Operators Permit issuance. The 10 days is counted by postmark date if requesting an administrative hearing by mail. 

How do I request a driving record?

A complete driving record can be requested by completing SFN 51386SFN 51386 must be mailed to the Driver License Division with a check or money order. $3 fee per record applies. Emailed requests are not accepted. 

How many points are on my record?

What’s the difference between a limited driving record and a complete driving record?

Limited driving records will not include the following information:

  • Certain reinstatement information
  • Original date first North Dakota license was issued
  • Crash information 

How long does information stay on my North Dakota driving record?

Information stays on your North Dakota driving record for different periods of time depending on what the information is, and the class of your driver license.

  • Non-commercial/non-criminal traffic violations stay on record for 3 years
  • Driving Under Suspension and Driving Under Revocation stay on record for 5 years
  • Serious commercial violations stay on record for 4 years
  • Disqualifying commercial offenses stay on record for life
  • Non-commercial alcohol violations stay on record for 7 years
  • Non-commercial crashes stay on record for 7 years
  • Commercial crashes stay on record for 10 years
  • Commercial crashes in a CMV involving a fatality stay on record for life 

How can I reduce the points on my record?

You can reduce points on your North Dakota driving record by completing an approved defensive driving course. Approved courses can be found here www.dot.nd.gov/driver/driver-education/driver-license-points-reduction-and-points-schedule. Please note defensive driving can only be utilized for point reduction once every 365 days. If your driving privileges were canceled or suspended as result of point accumulation, point reduction will not be applied until the cancelation and/or suspension is served. Defensive driving certificates should be emailed to drs@nd.gov.

Defensive driving for point reduction is not required. You will be credited one point back every three months your driving record remains free of new point violations.

How many points can I have before my license is cancelled or suspended? 

For drivers under the age of 18, your driver license or permit will be cancelled upon accumulating 6 or more points. For drivers of all ages, your driving privileges will be suspended upon accumulating 12 or more points. Suspension time is 7 days for every point over 11.

Will taking a defensive driving course stop my license from being cancelled or suspended?

Taking a defensive driving course will not stop your driving privileges from being cancelled or suspended unless you have been approved by the court to complete defensive driving in lieu of points. Defensive driving in lieu of points is available for citations with up to a five-point value. The appropriate court must indicate to our office that defensive driving in lieu of points is acceptable.

The defensive driving completion certificate must be submitted to our office within 30 days of the citation conviction date. Certificates can be emailed to drs@nd.gov . Note, defensive driving can only be utilized for point reduction once every 365 days.

Approved defensive driving courses can be found here www.dot.nd.gov/driver/driver-education/driver-license-points-reduction-and-points-schedule. Cancellation and/or suspension may still occur if other citations result in point accumulation over 6 (under the age of 18) or 11. 

Can I take a defensive driving course to remove violations from my record?

No, completing a defensive driving course will not remove violations from your driving record. Defensive driving is available for point reduction only. Approved defensive driving courses for point reduction can be found here www.dot.nd.gov/driver/driver-education/driver-license-points-reduction-and-points-schedule. If you are licensed out of state at the time a violation occurs, the citation will be applied to a North Dakota driving record, and sent to the state that you are licensed in. All states are free to apply citations to their driving records according to their individual state laws. Defensive driving course certificates are not forwarded to other states.

What is a SR22?

A SR22 is a high-risk insurance filing that is provided by an auto insurance company of your choosing. SR22 is an add-on to your standard insurance policy. Insurance ID cards, declarations pages, policy binders, etc. are not accepted for proof of SR22. SR22 forms can be emailed to drs@nd.gov or faxed to 701-328-2435. 

How much does a SR22 cost?

The cost of a SR22 is determined by the auto insurance company. 

How long do I need my SR22?

SR22 time requirements vary depending on the reason you require the SR22. See different scenarios below. If you are unsure how long you need to keep your SR22, please contact our office by phone or email.

  • DUI/APC conviction: one year from date of reinstatement, or one year from the date a Temporary Restricted License has been issued once requirement is in effect.
  • All Driving Under Revocation convictions or Driving under Suspension convictions that result in suspension longer than 90 days: one year from date of reinstatement, or one year from date a Temporary Restricted License has been issued once requirement is in effect.
  • Involvement in a crash with no insurance: one year from crash date
  • Conviction for Driving without Liability Insurance: one year from the date our office receives a sufficient SR22 filing or Certificate of Motor Vehicle Liability SFN 54148.
  • Making payments on a judgement: SR22 is required as long as you are making payments on a judgement. If your judgment has been satisfied in full, SR22 is no longer required.

Note, the amount of time a SR22 is required is always subject to change if/when new information is added to your driving record.

Do I need an SR22?

You can look up your reinstatement requirements online here https://apps.nd.gov/dot/dlts/dlos/reinstatement/search.htm. Note, if you are pending a conviction for DUI/APC the SR22 will not be required until DUI/APC conviction has been received from the court and applied to your driving record. 

Why do I need an SR22?

SR22 is accepted for Proof of Financial Responsibility, and Proof of Financial Liability requirements. Common reasons for these requirements include but are not limited to the following.

  • Conviction for Driving without Liability Insurance
  • Conviction for DUI or APC
  • Having no insurance at the time of a crash
  • Conviction for Driving Under Revocation
  • Conviction for Driving Under Suspension that results in suspension time longer than 90 days 

What is a TRL?

TRL is an acronym commonly used to describe a Temporary Restricted License. 

How do I get a Temporary Restricted License?

A Temporary Restricted License (TRL) may be issued to eligible applicants who have met outstanding requirements. SFN 2254 should be completed and emailed to dottrl@nd.gov. Applications are processed in the order received. 

How do I get a Temporary Restricted License?

Most reinstatement requirements must be completed prior to application for a Temporary Restricted License (TRL). Reinstatement requirements can be found here https://apps.nd.gov/dot/dlts/dlos/reinstatement/search.htm. If your requirements include the purchase of a license or permit, you do not need to complete the issuance prior to applying for the TRL. Additional requirements, such as 24/7 and written/road testing will be determined upon review of your TRL application. Additional direction on your TRL requirements will be provided by email or mail upon review of your application. TRL applications SFN 2254 should be emailed to dottrl@nd.gov. Must be a ND resident to apply. 

Where can I drive with a Temporary Restricted License?

A Temporary Restricted License (TRL) can be used to drive for the purposes of employment and life maintenance for yourself and any dependents. Ultimately, law enforcement has the discretion to determine if a TRL is being used correctly. Driver Record Services cannot provide direction on where you should or should not drive on a TRL. 

Is my Temporary Restricted License valid outside of North Dakota?

A North Dakota TRL may not be valid outside of the state of ND. Please contact the driver license office in the state you plan to travel for further guidance. 

Can I get a North Dakota Temporary Restricted License if I don’t live in ND?

No, you must be a North Dakota resident to be eligible for a TRL. 

If I’m suspended in another state, can I still get my license in North Dakota?

If you are suspended in another state, you will not be eligible for a standard North Dakota license or permit. However, you may be eligible for a Temporary Restricted License. SFN 2254 can be emailed to dottrl@nd.gov . Must be a ND resident. 

Can a minor get a Temporary Restricted License?

No, you must be 18 or older to be eligible for a TRL. 

Can you get a Temporary Restricted License to drive commercial?

No, TRLs are issued for non-commercial privileges only. You may use a TRL to operate within farm exemption limitations if required for employment or life maintenance.

Can I drive my motorcycle while on a Temporary Restricted License?

A Temporary Restricted License (TRL) can be issued for non-commercial class D privileges OR motorcycle privileges. But not both. Drivers must already have an existing motorcycle license. Testing for motorcycle is not allowed for TRL purposes. If you would like a TRL for motorcycle privileges, please indicate so on SFN 2254

Does it cost money to get a Temporary Restricted License?

There is no specific fee for a TRL. However, reinstatement requirements do apply. You are subject to a reinstatement fee, as well as fees for other requirements such as outstanding tickets, cost of SR22, addiction evaluation, treatment, testing fees, 24/7, etc. 

What do I need to do if I was convicted of Driving without Liability Insurance?

If you have been convicted of Driving without Liability insurance and have received a suspension order, you can view your requirements in detail online here https://apps.nd.gov/dot/dlts/dlos/reinstatement/search.htm .

If you have not received a suspension order but are concerned about a pending conviction and/or possible suspension for Driving without Liability Insurance, please contact our office by phone or email. 

What do I need to do if I got a citation for not having insurance during a crash?

If you have not received a suspension order but are concerned about a pending conviction and/or possible suspension for Driving without Liability Insurance, please contact our office by phone or email. 

Why is my license getting suspended if I had insurance during a crash?

You may receive a suspension order if there was no insurance information provided on the crash report, or if our office was unable to verify the insurance coverage that was provided on the crash report. 

What is a “Certificate of Motor Vehicle Liability”?

A certificate of Motor Vehicle Liability SFN 54148 is an acceptable document for drivers who have been convicted of Driving without Liability Insurance. SFN 54148 must be completed by an auto insurance representative and emailed to drs@nd.gov or faxed to 701-328-2435. The completed form must be emailed or faxed from the auto insurance representative. It will not be accepted from the driver.

How do I reinstate my CDL if I’m disqualified for life?

Requirements for lifetime CDL reinstatement are provided on the Application for Reinstatement of Lifetime CDL Disqualification SFN 61105. If you believe you meet the qualifications for lifetime CDL reinstatement, you may complete SFN 61105 and email the form to drs@nd.gov

What is the difference between a suspension, revocation, and cancellation?

Suspension is applied to a driving privilege. You do not have to have a North Dakota credential to be subject to suspension in North Dakota. Suspension may or may not require a period of time be served in addition to other requirements. Suspension requirements do not include written or road testing.

Revocation is applied to a driving privilege. You do not have to have a North Dakota credential to be subject to revocation in North Dakota. Unlike suspension, revocation will always include a period of time be served in addition to other requirements. A revocation will always result in written and road testing requirements.

Cancellation is applied to a North Dakota credential. Common reasons for cancellation include accumulating 6 or more points as a minor or being suspended in another state. Requirements for a cancellation may vary. 

What is a GDL cancellation?

GDL cancellation occurs when a driver under the age of 18 accumulates 6 or more points. The driver license or permit is cancelled, and the driver is required to start over to obtain their driver license. The process includes:

  • new parent/guardian sponsorship
  • written testing for permit
  • holding the permit for the required amount of time based on driver age
  • driver education completion
  • road testing for driver license 

What is 24/7 and why do I need it?

Information on the North Dakota 24/7 Sobriety Program can be found here https://attorneygeneral.nd.gov/public-safety/24-7-sobriety-program. For purposes of a Temporary Restricted License, the Driver License Division may require participation in the 24/7 program if upon the date of application, a driver has had one Refusal of testing in the last 7 years, or more than one alcohol/drug violation within the last 7 years and is not one year violation free of traffic violations. Please note, the court may require participation in the 24/7 program for different reasons and/or length of time. 

How long do I need to be in 24/7?

Compliance of the 24/7 program is required to maintain a TRL until the driver is one year violation free of all traffic violations. The requirement is based on your record on the date of application. Any time a TRL application is submitted, your record will be evaluated to determine if 24/7 is required. Please note, the court may require participation in the 24/7 program for different reasons and/or length of time.

How do I sign up for 24/7?

If you are enrolling in 24/7 for purposes of a Temporary Restricted License (TRL), you will be provided a 24/7 eligibility letter once your TRL application has been processed. You should provide the 24/7 eligibility letter to your local law enforcement to begin the process of enrollment. The 24/7 program should notify our office of enrollment. 

Does 24/7 cost money?

Do I need an Addiction Evaluation?

If you have been convicted in court of a DUI, APC, or equivalent offense, an addiction evaluation done by a licensed professional is required. If any type of treatment is recommended as a result of that evaluation, you must also complete the recommended treatment. SFN 9585 is recommended and should be completed by the evaluator. The evaluation must be done after the date of violation. Evaluation documents can be emailed to drs@nd.gov 

Do I need to complete Addiction Treatment?

I did everything the court told me to do, why am I still suspended?

Administrative requirements with the Department of Transportation pertain specifically to your driving privileges and are different than requirements enforced by the court. Documentation for requirements may need to be submitted to both the court and Driver Record Services.

Example: If your addiction evaluation was provided to the court, it must also be provided to our office. The court will not forward evaluation/treatment documents. 

Do I have to retest to get my license?

You may need to complete written and road testing to obtain a North Dakota permit or license if:

  • Your driving privileges have been revoked. Common reasons for revocation include but are not limited to refusal of testing, or fraudulent use of a driver license (fake ID)
  • Your driver license has been expired more than one year
  • Your permit or license has been cancelled as a result of GDL cancellation

Other scenarios apply. Testing requirements are determined at the time of application for a permit, license, or TRL.

What if I never got the suspension order in the mail?

Drivers are required by North Dakota law to notify the Driver License Division within 10 days of any address change. No exceptions will be made if a suspension order was not received.
